Legal?

Hey guys, I am unsure if this is within the right forum, but anyway I am asking about the legalities of this game.

When I first saw this, I nearly downloaded, but I am unsure as to whether it is legal to have as "Pokemon" is a trademark of Nintendo. A reply to this would be greatly appreciated.

Fair Use, mate... credit is given where credit is due and we're not making money off of this. It's completely legal. Plus, I know of a lot of different NFP game remakes out there... Sonic 3 HD, Countless ROM Hacks.
